Terms & Conditions

Last Updated: July 20, 2026

Welcome to the KidWise Counseling website. These Terms and Conditions govern your access to and use of **kidwise links, and related online features (collectively, the “Website”).

Throughout these Terms, “KidWise Counseling,” “KidWise,” “we,” “us,” and “our” refer to KidWise Counseling. “You” and “your” refer to any person who accesses or uses the Website.

By accessing or using this Website, you agree to these Terms and Conditions. If you do not agree with these Terms, please discontinue use of the Website.

1. Website Information Is Not Medical or Mental Health Advice

The information provided on this Website is intended for general educational and informational purposes only.

Website content does not constitute:

  • Medical advice

  • Mental health advice

  • Psychological or psychiatric advice

  • A diagnosis

  • A treatment recommendation

  • Crisis intervention

  • A substitute for professional evaluation or care

Information about anxiety, obsessive-compulsive disorder, ARFID, phobias, perfectionism, body-focused repetitive behaviors, parental stress, PANS/PANDAS, and other concerns is provided to help visitors better understand these topics. It should not be used to diagnose yourself, your child, or another person.

Always consult an appropriately qualified healthcare or mental health professional regarding individual symptoms, diagnoses, treatment decisions, or medical concerns.

2. This Website Is Not for Emergencies

The Website, its contact forms, email addresses, consultation requests, and client portal are not intended for emergencies or crisis situations.

KidWise Counseling does not continuously monitor Website submissions, email, voicemail, or portal messages.

If you or another person may be in immediate danger, is experiencing a medical or mental health emergency, or may harm themselves or someone else:

  • Call 911 or go to the nearest emergency room.

  • Call or text the 988 Suicide & Crisis Lifeline at 988.

  • Contact an appropriate local emergency or crisis-response service.

Do not use the Website, email, or a consultation request to seek emergency assistance.

3. Use of the Website Does Not Create a Therapeutic Relationship

Accessing the Website, reading its content, submitting a contact form, requesting a consultation, exchanging preliminary communications, or receiving general information from KidWise Counseling does not create a therapist-client relationship.

A therapeutic relationship is established only after the appropriate intake process has been completed, KidWise Counseling has determined that the practice is an appropriate fit, all required consent and practice documents have been signed, and services have formally begun.

KidWise Counseling is not obligated to accept any person as a client merely because that person has contacted the practice or requested a consultation.

4. Clinical Services and Provider Licensure

KidWise Counseling currently provides therapy and related services through telehealth.

Clinical services may only be provided when the client is physically located in a state or jurisdiction where the treating provider is legally permitted to practice. KidWise Counseling currently provides services to eligible clients located in Maryland and Wisconsin, subject to provider licensure, clinical appropriateness, availability, and applicable law.

Being located in Maryland or Wisconsin does not guarantee that KidWise Counseling will be able to accept or continue working with a particular client. Services may not be appropriate for every person, condition, age, or level of care.

Clients are responsible for accurately reporting their physical location at the time of each telehealth appointment.

5. Parent, Guardian, and Minor Use

KidWise Counseling provides services involving children, teens, parents, caregivers, and adults. However, the Website is primarily intended for use by adults.

Parents and legal guardians are responsible for supervising a minor’s use of the Website and for submitting consultation requests or personal information on the minor’s behalf when appropriate.

Nothing on the Website changes or replaces applicable requirements concerning parental consent, minor consent, custody, decision-making authority, or access to treatment records. These matters will be addressed through KidWise Counseling’s intake and informed-consent process when applicable.

6. Consultation Requests and Website Communications

You may be able to request a consultation, submit a contact form, send an email, call the practice, or access an external client portal through the Website.

Submitting information does not guarantee:

  • A response within a particular period

  • An available appointment

  • Acceptance as a client

  • A specific provider

  • A particular treatment recommendation

  • That KidWise Counseling is clinically appropriate for your needs

You agree to provide information that is accurate, current, and complete.

Please do not include urgent information or highly sensitive medical or mental health details in a general Website contact form or ordinary email. Electronic communications may carry privacy and security risks, particularly when they occur outside the secure client portal.

KidWise Counseling may respond by telephone, email, voicemail, or another method using the contact information you provide, subject to applicable privacy requirements.

7. Client Portal and Third-Party Platforms

The Website may contain links to a secure client portal, telehealth system, scheduling service, payment processor, social media platform, or other third-party website or service.

These third-party platforms are operated independently and may have their own:

  • Terms of service

  • Privacy policies

  • Security practices

  • Accessibility standards

  • Data-collection practices

Your use of a third-party platform is governed by that provider’s policies in addition to any agreements you have with KidWise Counseling.

KidWise Counseling does not control and is not responsible for the availability, content, security, performance, policies, or practices of independent third-party services.

8. Clinical and Financial Policies

Information on the Website regarding appointments, insurance, superbills, fees, payment, Good Faith Estimates, telehealth, cancellations, scheduling, or treatment is provided as a general overview.

The specific terms governing clinical services will be contained in the documents provided during intake, which may include:

  • Informed-consent documents

  • Telehealth consent

  • Practice policies

  • Financial agreements

  • Cancellation and attendance policies

  • Privacy notices

  • Good Faith Estimates

  • Other client-specific forms or agreements

If these Website Terms conflict with a signed clinical, financial, or informed-consent document, the signed document will control with respect to the clinical relationship.

KidWise Counseling is an out-of-network provider. Any insurance reimbursement information provided on the Website is general information only. Coverage and reimbursement decisions are made by the client’s insurance company, and KidWise Counseling cannot guarantee reimbursement.

9. Notice of Privacy Practices and Website Privacy

These Terms and Conditions do not replace KidWise Counseling’s Notice of Privacy Practices, informed-consent documents, or Website Privacy Policy.

Information created or maintained as part of an established therapeutic relationship may be protected by federal and state privacy laws and will be handled according to the applicable Notice of Privacy Practices and clinical agreements.

Information submitted through the public Website before a therapeutic relationship is established may not receive the same legal protections as information maintained within a client’s clinical record.

Please review the Website Privacy Policy for additional information about how Website information may be collected, used, stored, or shared.

10. No Guarantee of Results

KidWise Counseling provides information about evidence-based and specialized approaches to therapy. However, mental health treatment is individualized, and outcomes vary.

Nothing on the Website guarantees:

  • A diagnosis

  • Eligibility for services

  • Improvement in symptoms

  • A particular treatment outcome

  • The length of treatment

  • Insurance reimbursement

  • That a particular therapeutic approach will be appropriate or successful

Testimonials, professional endorsements, descriptions of treatment approaches, and examples of potential benefits are not promises or guarantees of individual results.

11. Intellectual Property

Unless otherwise stated, the Website and its content are owned by or licensed to KidWise Counseling and are protected by applicable intellectual property laws.

Protected content may include:

  • Website copy

  • Articles and educational materials

  • Graphics

  • Logos

  • Branding

  • Photographs

  • Videos

  • Modify or create derivative works from Website content

  • Remove copyright, trademark, or ownership notices

  • Use Website content to misrepresent an affiliation with KidWise Counseling

  • Reproduce Website materials on another website, publication, course, or commercial platform

Limited sharing of links to publicly available Website pages is permitted, provided the material is not presented in a misleading manner.

12. Acceptable Use

You agree not to use the Website:

  • For unlawful, fraudulent, threatening, or abusive activity

  • To impersonate another person

  • To submit knowingly false or misleading information

  • To interfere with Website functionality or security

  • To introduce malware, viruses, or harmful code

  • To gain unauthorized access to accounts, systems, or data

  • To collect information about other users without authorization

  • To overload, scrape, crawl, or automatically extract Website content in a manner that disrupts the Website

  • To violate another person’s privacy or intellectual property rights

  • To send unsolicited promotional messages or spam

KidWise Counseling may restrict or terminate access to the Website when it reasonably believes these Terms have been violated.

13. Third-Party Links and Resources

The Website may link to external resources for convenience or educational purposes. A link does not necessarily constitute an endorsement, sponsorship, recommendation, or guarantee.

KidWise Counseling does not control third-party content and is not responsible for its accuracy, completeness, availability, safety, or continued relevance.

You access third-party websites and resources at your own discretion and subject to their applicable terms and policies.

14. Website Availability and Accuracy

KidWise Counseling works to provide helpful and accurate information but does not warrant that Website content will always be complete, current, error-free, or appropriate for every individual situation.

Mental health information, professional standards, regulations, availability, services, fees, and practice policies may change over time.

KidWise Counseling may update, correct, remove, suspend, or discontinue any portion of the Website without prior notice.

We do not guarantee that the Website will operate without interruption, delay, technical failure, security issue, or compatibility problem.

15. Disclaimer of Warranties

To the fullest extent permitted by law, the Website is provided on an “as is” and “as available” basis.

KidWise Counseling disclaims all warranties, express or implied, concerning the Website, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, availability, and noninfringement.

Nothing in this section limits any warranty or right that cannot legally be excluded.

16. Limitation of Liability

To the fullest extent permitted by applicable law, KidWise Counseling and its owners, clinicians, employees, contractors, representatives, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:

  • Your use of or inability to use the Website

  • Reliance on Website content

  • Delayed or undelivered communications

  • Third-party websites or platforms

  • Unauthorized access to or alteration of Website submissions

  • Technical failures, outages, viruses, or harmful code

  • Decisions made based on general Website information

Nothing in these Terms is intended to exclude or limit liability where doing so would be prohibited by law.

These limitations apply only to the use of the public Website. They do not alter any legal or professional obligations that apply within an established therapist-client relationship.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless KidWise Counseling and its owners, clinicians, employees, contractors, and representatives from claims, liabilities, losses, damages, and reasonable expenses arising from:

  • Your unlawful or unauthorized use of the Website

  • Your violation of these Terms

  • Your infringement of another person’s rights

  • Information or material you submit through the Website in violation of law

This section does not require you to indemnify KidWise Counseling for conduct for which indemnification would be prohibited by law.

18. Changes to These Terms

KidWise Counseling may revise these Terms and Conditions as the Website, services, technology, or applicable requirements change.

Revised Terms will be posted on this page with an updated “Last Updated” date. Your continued use of the Website after updated Terms are posted constitutes acceptance of the revised Terms.

19. Governing Law

Except where prohibited by applicable law, these Terms and any dispute concerning the public Website will be governed by the laws of the State of Maryland, without regard to conflict-of-law principles.

Nothing in these Terms prevents the application of consumer-protection, healthcare, privacy, or professional-practice laws that cannot legally be waived or displaced.

20. Severability and Waiver

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will remain in effect.

A failure by KidWise Counseling to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
